Cancellation Policies
Terms and conditions for booking changes, cancellations and refunds and refundable damage deposits are specific to each Hotel, each property that is listed.
Traveller Terms & Conditions
- Introduction
(1) The www.Pubstops.com.au website, and any mobile application for the website (the “Site”) is owned and operated by Pubstops Accommodation ABN 165 567 36678, 10 Burford Crescent Redwood Park SA 5097(“Pubstops”, “we” , “us” or “our”).
(2) These terms and conditions (the “Traveller Ts&Cs”) together with the Privacy Policy govern, the relationship between Pubstops and any individual using or accessing the Site and any of the content or services available through it as a traveller or potential traveller, and who is not using it in his/her/its capacity as a property owner or property manager (each, a “Traveller” or “you”). Travellers include people who use the Site to access information about and to rent vacation properties.
(3) The Traveller Ts&Cs constitute a legally binding agreement between Pubstops and the Traveller. By using or accessing the site or Pubstops’s platforms or systems, you acknowledge that you agree to and are subject to the Traveller Ts&Cs as well as our Privacy Policy. If you do not fully agree to the Traveller Ts&Cs, you are not authorised to access or otherwise use the Site.
(4) Pubstops does not authorise anyone to register with this site unless they are able to enter into legally binding contracts.
(5) Pubstops may revise these Traveller Ts&Cs at any time by posting an updated version to this web page. You should visit this page periodically to view the most current Traveller Ts&Cs because they are binding on you.
- The Basics Perhaps replace the word
(1) This Site is a place where Travellers can view advertising of, and obtain information about, hotel accommodation
(2) The Site acts only as a venue for users to interact, and Pubstops is not, and does not become, party to any contractual relationship between the Traveller and the hotel, and does not mediate between the Traveller and the hotel in the event of any dispute arising between them. This is true even if the Site facilitates booking of or payment for a Property or the use of other tools, services or products, as Pubstops is not a party to any rental or other agreement between Travellers and hotel.
- Accommodation Listings
(1) Hotels are entirely responsible for all of the information, including images, text and other content, relating to the accommodation they offer (“Listings”), for updating them and ensuring (where relevant) that they are correctly translated.
(2) If a Traveller finds accommodation in which they are interested, they can send an information request to the Hotel (an “enquiry”) stating their surname, e-mail address and telephone number, along with any requested information, without having to log in to the Site for the purpose.
(3) The Traveller will receive a confirmation from Pubstops once an enquiry has been sent to the Hotel.
(4) The Hotel will then communicate with the Traveller in connection with the enquiry.
(5) Enquiries using the Pubstops system are available for review by the person to whom it was initially addressed and to a limited number of Pubstops staff. Pubstops also monitor messages from time to time which are sent using our platforms. Pubstops may, from time to time, use third party e-mail servers to send and track receipt of the enquiry emails, and analyse the pattern of enquiry usage reported by these third party tracking systems. Our system does not hold messages indefinitely and they may not be accessible after the message has been delivered to you.
Please print a copy of any message which is important to you – for example a payment receipt or a booking confirmation.
(6) Pubstops has no responsibility for or involvement in, the communications between the Hotel and Traveller.
(7) The Hotel you have booked with may ask for a deposit to be paid to secure the booking.. Pubstops does not become involved in the payment or return of damage deposits. Return of these amounts is based on the Hotels terms and conditions and their inspection of the accommodation after your stay.
- Rights and obligations of Pubstops
(1) Pubstops shall use commercially reasonable efforts to ensure that depictions on the site of the photos of the Properties that the Hotels have submitted to Pubstops are as true and accurate a representation of those photos as practicable. However, you acknowledge that deviations from original photos can occur when scanning non-digital images, and due to individual screen settings.
(2) Further, you also acknowledge that the Hotels – and not Pubstops – are responsible for the accuracy with which the photos depict the relevant Property.
(3) Pubstops may occasionally undertake upgrades and maintenance of the site, its platforms and systems. These works may result in restrictions on the usage. Pubstops will, where possible, aim to ensure that works that cause any such restriction are undertaken at a time when most Travellers’ usage is least affected.
(4) Pubstops offers a messaging system which may be used by the Hotel and Traveller for making contact with one another. Completed enquiry contact forms will be forwarded to the email provided by the Hotel of the relevant Property. You acknowledge that unauthorised third parties may misuse the system and unlawfully intercept or read messages. Pubstops is not liable for any such misuse.
(5) You acknowledge that Pubstops is not responsible for checking the identity, or for the behaviour, of Hotels or for establishing the nature, condition or existence of a Property.
(6) Pubstops reserves the right to transfer these Traveller Ts & Cs, and to assign or subcontract any or all of its rights and obligations under these Traveller Ts & Cs, to a third party but will not do so in such a way as to reduce any guarantees you are given under these Traveller Ts & Cs.
- Intellectual Property and Related
(1) All content that appears on this site, and the site itself, is protected by copyright and database rights. Reproduction of the site, in whole or in part, including the copying of text, graphics or designs, is prohibited.
(2) Travellers are permitted to download, display or print individual pages of the site to evidence their agreement with Pubstops.
(3) Where a Traveller submits to or transmits through the site or Pubstops’s platform or systems any content of any type, including text or images, the Traveller undertakes that he/she has the right to do so, and has been granted the necessary consent by any persons featured (’model release’) or hotels of featured items (’property release’).
(4) To the extent that Travellers’ reviews or other content may contain trade marks or other proprietary names or marks, Travellers undertake that they have the right to do so.
(5) By submitting reviews to the site, Travellers authorise Pubstops to use them both on the site and in separately published form.
(6) Pubstops also uses Google Analytics to gather statistics on site usage. There are more details in the Privacy Policy and Cookie Notice and in Google’s own privacy policy. Google may aggregate data they collect from their various services including Google Analytics, Google Translate, Google Maps and other Google services including YouTube. You understand and accept that the HomeAway Group has no control over Google’s data collection.
- Communications and Reviews
(1) Travellers must provide only accurate and truthful information concerning their identity in any communications on the Site, including reviews of Properties.
(2) Messages sent via Pubstops systems should only relate to genuine booking enquiries. We do not tolerate spam or unsolicited commercial electronic communications of any kind. It is prohibited to misuse Pubstops systems, such as by sending unsolicited commercial communications (spam) or disclosing personal information of users to a third party, unless you have the express permission from the user. E-mails and site recommendations transmitted via the “Recommend this site” function should only be sent with the recipient’s consent. You agree that you will protect other users’ personal information with the same degree of care that you protect your own confidential information (using at minimum a reasonable standard of care), and you assume all liability for the misuse, loss, or unauthorised transfer of such information.
(3) Travellers may post their reviews of Hotels (“Traveller Reviews”) on the site. The Hotel is given the opportunity to view Traveller Reviews, and to respond to them (a “Hotel Response”). Some more detail about Traveller Reviews and Hotel Responses is available here.
(4) Please note that Pubstops does not, and realistically does not have the ability to, verify the accuracy or otherwise of Traveller Reviews or Hotel Responses.
(5) Pubstops nevertheless requires all Traveller Reviews, hotel responses and other communications using Pubstops systems to conform to the Content Guidelines, and may decline to post any of them that Pubstops finds do not comply.
(6) In the event that any Traveller Review appears on the site but fails to conform to the Content Guidelines, then without prejudice to any other available remedies, Pubstops shall be entitled immediately to remove from the site the relevant non-conforming Traveller Review.
(7) Pubstops does not generally conduct identity checks. If Travellers suspect that the Hotel has supplied false information, they are invited to notify Pubstops through the contact form.
(8) Pubstops complies with its Privacy Policy. Further details can be obtained from the Privacy Policy . The Traveller consents to the use of his data as outlined in the Privacy Policy. Owners generally authorise Pubstops to forward the Hotels contact details, including telephone number, to Travellers in connection with a Property booking. Travellers may ask for these details to be supplied on production of proof of the booking; alternatively, these details may be made available to Travellers through their Accounts.
- Indemnification
You agree to indemnify and hold Pubstops and its affiliates (“Pubstops Affiliates”) harmless against any claims by third parties brought against Pubstops or any Pubstops Affiliate arising out of or in connection with: (a) any material or content you provide to the Site; (b) your use of any content on the Site; or (c) any breach by you of these Traveller Ts&Cs. Pubstops will provide notice to you promptly of any such claims.
- Prohibitions
The Traveller shall not directly or indirectly:
a) With respect to the site, its content, and databases comprised in the site, in any form, whether by using automatic devices or manual processes, exploit, copy, distribute, reproduce, edit, translate, make publicly accessible or decompile any of the same;
b) Monitor content on the site or Pubstops platform or systems by means of robots, spiders, or other automatic instruments; provided, however, that a limited exception from the foregoing exclusion is provided to general purpose internet search engines (not including any website or search engine or other service that provides classified listings or property rental adverts, or any subset of the same or which is in the business of providing vacation property rental services or other services that compete with the site or Pubstops) and non-commercial public archives that use tools to gather information for the sole purpose of displaying hyperlinks to the Site, provided they each do so from a stable IP address or range of IP addresses using an easily identifiable agent and comply with Pubstops robots.txt file;
c) Use the site or Pubstops platform or systems for purposes other than those referred to in these Traveller Ts & Cs;
d) Use the site or the tools and services on the site for the purpose of booking or soliciting a rental for a property other than a Property under a valid Listing;
e) Reproduce any portion of the site on another website or otherwise, using any device including, but not limited to, use of a frame or border environment around the site, or any other framing technique to enclose any portion or aspect of the site, or mirror or replicate any portion of the site;
f) Upload or send to the site or Pubstop’s platform or systems any contents or programs, which on account of their size or nature, might damage Pubstops computers or networks;
g) Include content on the site or Pubstops platform or systems that breaches any applicable criminal or other laws, or encourages any such breach;
h) Use or access the Site or Pubstops platform or systems in any way that might endanger any computer system or network, including by making available any virus (for which purpose, “virus“ includes any program introduced into a system deliberately which carries out a useless and/or destructive function, such as displaying an irritating message or systematically over-writing the information on a user’s hard disk);
i) Post or transmit information that is in any way false, fraudulent, or misleading, or engage in any act that may be considered “phishing” (whether primary, secondary or other) or that would give rise to criminal or civil liability;
j) Post or transmit any unlawful, threatening, abusive, libellous, defamatory, obscene, vulgar, indecent, inflammatory, sexually explicit, pornographic or profane material; or
k) Refer to Pubstops or any Pubstops Affiliate in any way that might lead someone to believe that the Traveller or any website is sponsored by, affiliated with, or endorsed by Pubstops or any Pubstops Affiliate.
- Right to delete content
Travellers are responsible for ensuring that their communications, and content posted, through or in connection with the site, including Traveller Reviews and communications with the Hotel, do not infringe the law, the rights of any person or entity, or contain false information, personal insults, anything slanderous or defamatory, anything that infringes copyright, data protection law or the Content Guidelines . Pubstops may monitor any data on the Site or Pubstops platform or systems and delete it or alter it when it is no longer accurate or up-to-date. Without prejudice to any other available remedies, Pubstops shall be entitled immediately to remove from the site any communications or content that infringes these requirements, and to suspend or prevent the usage of any related Account.
- Notifications
(1) Messages are to be sent using the contact form or by email to info@Pubstops.com.au
(2) Notifications of copyright infringement must contain:
- Your postal address, telephone number and e-mail address;
b. Precise details about the content in question (insertion of the text or image) including a link to the website;
c. A signed declaration in lieu of an oath, which evidences that you:
i. Hold the exclusive rights to use the work;
ii. Have not authorised the use of the material in question in this form.
- Liability of Pubstops
Pubstops has taken all practical steps from both a technical and systems perspective to ensure that all of your information is well protected. A secure payment gateway is used to process all transactions and card details. However, Pubstops does not give any warranty or make any representation regarding the strength or effectiveness of the secure payment gateway and is not responsible for events arising from unauthorised access to your information.
In no event will Pubstops be liable for any lost profits or any indirect, consequential, special, incidental, or punitive damages arising out of, based on, or resulting from the site or Pubstops platform or systems, any materials or content you submit to the Site, and your use of the Site and/or any transaction between users, even if Pubstops has been advised of the possibility of such damages. These limitations and exclusions apply without regard to whether the damages arise from breach of contract, negligence or any other cause of action. If you are dissatisfied with the site or Pubstops platform or systems, you do not agree with any part of these Traveller Ts & Cs, then your sole and exclusive remedy against Pubstops is to discontinue using the site. Nothing in these Traveller Ts & Cs shall exclude or restrict Pubstops liability for death or personal injury resulting from its negligence; nor for Pubstops fraud or fraudulent misrepresentation.
- Miscellaneous
(1) These Traveller Ts & Cs, and the relationship between the Owner and Pubstops, shall be governed by and construed in accordance with the laws in force in South Australia and you submit to the non-exclusive jurisdiction of the courts in that State.
(2) These Traveller Ts & Cs, the Privacy Policy and the Cookie Notice contain the entire agreement between Pubstops and Traveller relating to their subject matter.
(3) Pubstops recommends that you save your own copy of these Traveller Ts & Cs in a separate file on your device or in print-out form.
(4) Pubstops failure to act with respect to a breach of these Traveller Ts & Cs by the Traveller or others does not waive Pubstops right to act with respect to subsequent or similar breaches.
(5) The headings to the Clauses are for ease of reference only and do not affect the interpretation or construction of these Traveller Ts & Cs.
(6) The invalidity of one or more provisions of these Traveller Ts & Cs shall not affect the validity of the other provisions.
Pubstops Privacy Policy
- Purpose of Policy
This Privacy Policy applies to the collection, use, disclosure and handling of personal information by Pubstops and its associated entities (collectively “Pubstops”, “we” or “us”). Pubstops is committed to protecting the privacy of individuals and is bound by the Australian Privacy Principles set out in the Privacy Act 1988 (Commonwealth) (the “Act”). We will only collect, use or disclose personal information in accordance with the Act and this Privacy Policy.
Pubstops, owns and operates the site www.Pubstops.com.au (the “Site”); an online venue where travellers can view advertising of, and obtain information about, accommodation offered for rent by others, including property owners, lessees and managers. The terms “users” or “you” as used in this Privacy Policy, refer to both travellers, who use the Site to look for properties to rent, and members who subscribe to the Site and list their properties for rent.
By providing information to us when subscribing, sending enquiries or otherwise using the Site, you expressly agree to this Privacy Policy.
- What types of information do we collect?
Personal Information
The type of personal information that we collect and hold about you depends on the type of dealings that you have with us.
For example, in order to process a request or enquiry from you, we may need to know all or some of the following: your full name, address, telephone number, e-mail address, your current location, and, in the case of a member’s listing, a method of payment.
We may also gather information from cookies or web beacons. You can find out more about how they operate in the relevant section of this policy below.
We also collect IP addresses, mobile device identifier details, your location, navigation and click-stream data, the time of accessing the Site, homes you viewed, what you searched for, the duration of your visit, and other details of your activity on the Site.
If you ask us to connect with other sites (for example if you ask us to connect with your Facebook account) we may get information that way too.
Information that we collect from third parties, such as credit information which we use to prevent and detect fraud, information from your mobile provider if you are accessing the Site over a mobile device or information from a third party such as a social media or travel opinions site where you have asked us to share your data with them.
Sensitive information
Sensitive information is personal information such as health information and information about racial or ethnic origin that is generally afforded a higher level of privacy protection. We only collect sensitive information where it is reasonably necessary for our business functions and you have consented, or we are required to do so by law.
Information other than personal information (“non-personal information”)
When you visit the Site, some of the information that is collected about your visit is not personal information, because it does not reveal your identity. We use this information to help us improve our services. We may aggregate this information for our own statistical purposes. Provided that it remains anonymous, we may disclose that aggregated information to third parties for marketing or other business related purposes.
Cookies
A “cookie” is a small file placed on your hard drive by certain of our web pages. We or third parties under contract with us may use cookies to help us analyze our web page flow, customize our services, content and advertising, measure promotional effectiveness and promote trust and safety. We gather and share information concerning the usage of the Site by members and travellers with one or more third-party tracking companies for the purpose of reporting statistics. In this connection, some of the pages you visit on our Site use electronic images placed in the web page code, called pixel tags (also called a “clear GIFs” or “Web Beacons”) that can serve many of the same purposes as cookies.
Web beacons may be used to track the traffic patterns of users from one page to another in order to maximize web traffic flow. Our third-party advertising service providers may also use Web Beacons to recognize you when you visit the Site and to help determine how you found the Site. - How do we collect personal information?
Methods of collection
We will collect personal information by lawful and fair means as required by the Privacy Act. We will also collect personal information directly from you where this is reasonable and practicable.
We collect personal information in a number of ways, including:
- Directly from you in person, by email, over the telephone, through written communications (such as letters and faxes) or by you completing forms or submitting information on the Site;
- Through our Site, for example if you make an enquiry to a property owner, or if you purchase a subscription to list advertise your property;
- From third parties,
- including: direct marketing database providers,our related companies,
- public sources, such as telephone directories,
- membership lists of business, professional and trade associations,
- ASIC searches;
- From our own records of your use of our services.
- Why do we collect, hold, use and disclose your personal information?
General
The main purposes for which we collect, hold, use and disclose personal information are:
- To identify you and verify your identity;
- To communicate with you about our services;
- To contact you from time to time with critical user or service updates;
- To assist people you have done business with. For example if you are an owner and a traveller who has booked or enquired with you needs your details we may pass them on; if you are a traveller and an owner you have booked with needs to contact you we may give them your details;
- To customize, measure and improve our services, content and advertising;
- To compare information for accuracy, and verify it with third parties;
- To prevent activity we determine to be potentially illegal, unlawful or harmful and to enforce our Privacy Policy and/or our Terms or any other purpose referenced herein or therein. We collate statistics about site traffic, sales and other commercial information which we pass onto third parties to assist us in improving the services we provide to you. We also use demographic information to tailor the Site and we share that information with third parties so that they can build up a better picture of our customer base and general consumer trends; and
- for any other purposes that you have consented to.
Direct marketing
Where we have your express or implied consent, or where we are otherwise permitted by law, we may contact you with information about our products and the services on the Site, or those of our Pubstops and/or our affiliates. You can opt out of receiving these communications at any time, by either contacting Customer Support, or by using the unsubscribe facility that we include in our commercial electronic messages (i.e., email) to opt out of receiving those messages.
- To whom do we disclose your personal information?
We may disclose your personal data to enforce our policies, or where we are permitted to do so by applicable law, such as in response to a valid, legally-compliant request by a law enforcement or governmental authority, or in connection with actual or proposed litigation, or to protect our property, people and other rights or interests.
We may also share your personal data with:
- One of our partners if you’ve requested their services or if you’ve requested to be provided with information by them;
- Another member if you have done business with them;
- Companies in the Pubstops group and/or affiliates;
- Other companies we work with to feature all or part of our member’s property listings or otherwise provide promotional or other services related to our or HomeAway group’s business. This might include featuring your listings and photographs on other websites;
- Any third party you have asked us to share your personal data with – such as Facebook if you have asked us to connect with your Facebook account; or
- Our contracted services providers, including:
- Information technology service providers (including cloud services providers);
- Marketing, communications and research agencies;
- Mailing houses, postal, freight and courier service providers;
- Printers and distributors of direct marketing materials;
- External business advisers (such as recruitment advisers, auditors and lawyers).
- If you choose to send an enquiry to a member on a Site, your personal information, including your email address and any other information you supply (unless the Site specifies otherwise), will be visible to the relevant member so that they can reply directly to you. Enquiries sent using the Pubstops system are also available for review to a limited number of customer service employees, who may be asked by a member or others for their past enquiry information.
In the case of these contracted service providers, we may disclose personal information to the service provider and the service provider may in turn provide us with personal information collected from you in the course of providing the relevant products or services.
We may de-identify and aggregate the personal information of you and others for our own statistical purposes. Provided that it remains permanently de-identified, we may disclose that aggregated information to third parties or publish it for marketing or research purposes.
If you post comments or otherwise communicate publicly with other users via our Site, any information about yourself that you include in the communication may be stored on the Site and accessed by other users. For this reason, we encourage you to use discretion when deciding whether to post any information that can be used to identify you.
In the event that Pubstops is sold, or some of its assets transferred to a third party, your personal information, as a valuable asset, may also be transferred. Potential purchasers and their advisors may have access to data as part of the sale process. However, use of your personal information will remain subject to this Privacy Policy. Similarly, your personal information may be passed on to a successor in interest in the unlikely event of a liquidation, bankruptcy or administration. Our customer database could be sold separately from the rest of the business, in whole or in a number of parts. It could be that the purchaser’s business is different from ours too.
- Data quality and security
We hold personal information in a number of ways, including in electronic databases, email contact lists, and in paper files held in secure premises. We take reasonable steps to:
- Make sure that the personal information that we collect, use and disclose is accurate, up to date and complete and (in the case of use and disclosure) relevant;
- Protect the personal information that we hold from misuse, interference and loss and from unauthorised access, modification or disclosure;
- Destroy or permanently de-identify personal information that is no longer needed for any purpose that is permitted under the Act.
Security
We implement a range of physical and electronic security measures to protect the personal information that we hold, including:
- mandatory password protection on all computers (users are required to change their passwords at regular intervals);
- hardware encryption on desktops, laptops and portable storage devices;
- secure hard copy document, electronic storage media and hardware disposal procedures;
- key card-restricted access to all offices;
- firewall and antivirus/malware software; and
- training and workplace policies.
Website security
While Pubstops strives to protect the personal information and privacy of users of the site, we cannot guarantee the security of any information that you disclose online and you disclose that information at your own risk. While no system is completely secure, we believe the measures implemented by the Site reduce our vulnerability to security problems to a level appropriate to the type of data involved. We have security measures in place to protect our user database and access to this database is restricted internally. However, it remains each user’s responsibility:
- To protect against unauthorized access to your use of the Site;
- To ensure no-one else uses the Site while the user’s machine is “logged on” to the Site (including by logging on to your machine through a mobile, Wi-Fi or share access connection you are using);
- To log off or exit from Site when not using it; and
- Where relevant, to keep your password or other access information secret. Your password and log in details are personal to you and should not be given to anyone else or used to provide shared access for example over a network; and
- To maintain good internet security. For example if your email account or Facebook account is compromised this could allow access to your account with us if you have given us those details and/or permitted access through those accounts. If your email account is compromised it could be used to ask us to reset a password and gain access to your account with us. You should keep all of your account details secure. If you think that any of your accounts has been compromised you should change your account credentials with us, and in particular make sure any compromised account does not allow access to your account with us. You should also tell us as soon as you can so that we can try to help you keep your account secure and if necessary warn anyone else who could be affected.
If you have asked us to share data with third party sites, however (such as Facebook) their servers may not be secure. Credit card information is generally stored by our credit card processing partners and we ask them to keep that data secure. We also use third parties to help us optimize our website flow, content and advertising (see below).
Note that, despite the measures taken by us and the third parties we engage, the internet is not secure,
and others may nevertheless unlawfully intercept or access private transmissions or data. As such, except to the extent liability cannot be excluded due to the operation of statute, Pubstops excludes all liability (including in negligence) for the consequences of any unauthorised access to your personal information. Please notify us immediately if you become aware of any breach of security.
Phishing or False emails
